Hurt in Colorado? What Illinois Visitors Should Know Before Filing a Claim

This post was originally published on this site.

If you get hurt in a car crash or a fall while you’re out there, a tough question comes up fast. Whose laws apply to your claim?

The short answer is that the state where the injury happened usually sets the rules. A Chicago driver hit in Denver may be dealing with Colorado law, not Illinois law. The two states look alike in some ways. In others, they’re not close.

Filing Deadlines Are Not the Same

Every state sets a deadline for filing an injury lawsuit. Miss it, and a court will likely dismiss your case, no matter how strong it is.

Illinois gives most injury victims two years. That rule sits in 735 ILCS 5/13-202, which says a personal injury lawsuit must begin within two years after the cause of action accrues.

Colorado is more generous for crashes. Under C.R.S. § 13-80-101(1)(n)(I), tort claims arising from the use or operation of a motor vehicle have a three-year statute of limitations. The Colorado Court of Appeals took up this exact question in a recent opinion on the three-year rule.

Not every injury has a three-year statute of limitations, though. A slip and fall at a hotel or rental cabin usually falls under the general two-year rule in C.R.S. § 13-80-102.

That’s a big gap to miss. Many people assume the deadline back home follows them across state lines. It doesn’t.

Fault Rules Can Decide the Outcome

Both states use a modified comparative fault system. If you’re partially at fault, your payout is reduced by your share. If you’re mostly at fault, you get nothing.

In Illinois, 735 ILCS 5/2-1116 bars recovery if you are more than 50 percent at fault. Colorado is a little stricter. Under C.R.S. § 13-21-111, you are barred if you are 50 percent or more at fault.

Here’s what that means in real life. A case with an even 50/50 split could still pay something in Illinois. In Colorado, the same facts could leave you with nothing.

Insurance adjusters know this. They often look for ways to move even a small piece of blame onto the injured person. A few percentage points can change everything.

What to Do After an Out-of-State Accident

Being away from home can make a bad day even worse. Here are steps to safeguard your claim while you deal with the rest:

  • Get medical care right away, even if you feel okay. Some injuries show up days later.
  • Call the police and ask for the report number before you leave the scene.
  • Take photos of the vehicles, the road, and your injuries.
  • Keep receipts for hospital visits, rental cars, and extra travel costs.
  • Be careful with recorded statements to any insurance company.

Also write down what happened while it’s fresh. Names, times, and weather all matter later.

Why Local Knowledge Helps

Laws are hard to read from 1,000 miles away. Courts, insurers, and deadlines vary by state.

A Colorado-based Denver personal injury attorney can explain how local rules apply to your situation. That includes which deadline applies and whether you should file in Colorado or closer to home. Asking those questions early costs you little and can save you a lot.

Getting hurt on vacation is stressful enough. Learning the rules early, and keeping an eye on the calendar gives your claim a better chance of staying on track.
